1. DEFINITIONS AND INTERPRETATION
In these terms and conditions the following words and expressions shall have the meanings respectively set against them:
“Consent Form”: The form signed by the Patient consenting to the Relevant Treatment;
“Doctor”: A general medical practitioner being registered to practice with the General Medical Council;
“Non-Surgical Treatment”: Treatment supplied by Regency Eye not being a surgical procedure;
“Nurse”: A nurse registered to practice by the Nursing and Midwifery Council;
“Patient”: Any person who has entered or is contemplating entering into a contract for a Surgical Procedure or Non-Surgical Treatment from Regency Eye;
“Patient’s Guide”: The pack of information so called to be provided to Patients by Regency Eye;
“Procedure”: A procedure to be procured by Regency Eye for a Patient of a surgical nature to be performed by a Surgeon; “Readmission Policy”: As set out in the Patient’s Guide;
“Refund Policy”: As set out in the Patient’s Guide;
“Relevant Practitioner”: A Nurse, Aesthetic Practitioner, Surgeon or Doctor (as the case may be);
“Relevant Treatment”: The Procedure or Non-Surgical Treatment booked through Regency Eye carried out or to be carried out on the Patient by a Relevant Practitioner;
“Rescheduling Policy”: As set out in the Patient’s Guide;
“Surgeon”: means a medical practitioner being registered to practice with the General Medical Council and being a Fellow of the Royal College of Ophthalmologists and/or the Royal College of Surgeons
“Regency Eye”: means The Regency Eye Clinic of 2 Gibwood Road, Northenden, Manchester M22 4BT.
“Regency Eye Complaints Procedure”: means the complaints procedure referred to in the Patient’s Guide.
2. REGENCY EYE CLINIC’S OBLIGATIONS
In providing a Relevant Treatment for a Patient, Regency Eye shall:
1. ensure that a Surgical Procedure is carried out by a Surgeon or a suitably qualified Practitioner;
2. ensure that a Non-Surgical Treatment is carried out by a suitably qualified Practitioner;
3. provide suitable facilities for the provision of Procedures and Non-Surgical Treatment by Surgeons, Doctors or Nurses (as the case may be);
4. provide the Patient with such information that can be reasonably expected to be necessary for the Patient to understand the nature of the Relevant Treatment being offered and the risks and conditions normally attendant on such Relevant Treatment.
3. PATIENT’S OBLIGATIONS
The Patient shall be responsible for reading and understanding these Terms & Conditions and information/literature provided prior to consenting to undergo any Relevant Treatment.
4. PAYMENT
The Patient shall pay a deposit of an amount stipulated by Regency Eye from time to time prior to an appointment with a Relevant Practitioner being made. Regency Eye’s Refund Policy shall apply to such deposit. The balance of the fee for the Relevant Treatment shall be paid in accordance with the payment schedule agreed with the Patient at the time that the date is booked. Late payment of outstanding balances will incur administrative costs which will be added to any debt.
5. RELATIONSHIP WITH RELEVANT PRACTITIONER
1. Regency Eye accepts no responsibility for matters which are within the professional responsibility of the Surgeon or Doctor.
2. All Surgeons and Doctors are independent contractors and are not employed by Regency Eye.
Regency Eye shall satisfy itself that:
3. The Relevant Practitioner is insured against claims for professional negligence on terms that Regency Eye reasonably considers are normal given prevailing market conditions at the relevant time with a Medical Defence Organisation;
4. The Relevant Practitioner holds the necessary qualifications and registration;
Without prejudice to the generality of 5.1 above the Surgeon or Doctor is solely responsible for deciding whether or not the Patient is suitable for the Relevant Treatment.
6. COMPLAINTS
In the event that the Patient is unhappy with any aspect of the service provided, the complaint should be made as soon as possible to the Clinic Manager. If he/she is unable to resolve the complaint to the reasonable satisfaction of the Patient, Regency Eye’s Complaints Procedure shall apply.
7. CONFIDENTIALITY/DATA PROTECTION
1. Regency Eye processes data relating to Patients in connection with the Relevant Consultation/Treatment/Procedure provided to those Patients in accordance with these terms and conditions.
2. Regency Eye wishes to disclose data relating to Patients to the Surgeons, Doctors, Nurses and Aesthetic Practitioners in the course of the Relevant Treatment and Regency Eye wishes to have the consent of the Patient to such disclosure.
3. The Patient is deemed to consent to the disclosure of sensitive personal data by Regency Eye to Surgeons, Doctors, Nurses and Aesthetic Practitioners for the purposes of discussing the Patient’s Treatment.
4. The Patient acknowledges that Regency Eye is obtaining this consent in order to comply with the provisions of the Data Protection Act 2018.
8. RESCHEDULING POLICY FOR SURGERY
1. If you pre-book a date for surgery and decide to reschedule that date, Regency Eye reserves the right to charge a rescheduling administration fee as follows:
2. In cases where a patient reschedules their booked date for surgery giving 14 days or more notice – the administration fee is £75.
3. In cases where a patient reschedules their booked date for surgery giving 13 days to 4 days notice – the administration fee is £250.
4. In cases where a patient reschedules their booked date for surgery giving 3 days or less notice the administration fee is £500.
These fees will be added to the total operation fee and will be payable prior to surgery.
Please note: If you subsequently cancel rescheduled surgery, then the refund policy will be applied based on the original scheduled period
